These Terms govern access to PropertyValue.mu, Smart Reports, accounts, payments, Property Directory, advisory enquiries and related services. By using the website or selecting the acceptance checkbox, you agree to these Terms and the Privacy Policy.
If you use the services for an organisation, you confirm that you have authority to bind it. Enterprise services are also governed by a signed agreement, and that agreement prevails where inconsistent.
You must be at least 18 and legally capable of entering a contract. Account information must be accurate and kept current. Credentials are personal to the authorised user and must not be shared unless an Enterprise plan expressly permits it.
You are responsible for activity conducted through your account except to the extent caused by our breach. Notify us promptly of suspected compromise.
A Property Intelligence Report is an automated, indicative market-intelligence service. A certified valuation, development appraisal, building audit or other professional advisory assignment is a separate service requiring written scope, fees, information and professional acceptance.
The website description, checkout summary and report order form define the included output. Features, data coverage and evidence availability may differ by property type and location.
You must provide complete and accurate information and must not knowingly submit false, misleading, unlawful or third-party data without authority.
You warrant that you have the right to upload documents, photographs, plans and listing content, and grant us the limited licence required to process, store, analyse and display them for the service.
We may suspend generation, request evidence or mark a report as limited where inputs are inconsistent, incomplete or implausible.
Reports are generated as at the stated valuation date from available data, user inputs and configured valuation methods. They may provide an estimate, range, confidence score, comparables, market statistics, location information, assumptions and limitations.
A report is not a guarantee of sale price, lending value, insurable value, tax value, development approval, title or condition. Market value can change after the report date.
Unless expressly stated, no site inspection, measurement, title review, boundary confirmation, building survey, structural assessment, environmental investigation or planning verification is performed.
A consumer Smart Report is licensed to the purchaser for personal or internal business decision support. It may be shared with professional advisers for that purpose, provided the report remains complete and the limitations are not removed.
No lender, insurer, court, tax authority, auditor, buyer or other third party may rely on a Smart Report as a certified valuation. A separate Enterprise or professional engagement is required for permitted institutional reliance.
You must not edit, misrepresent, extract the conclusion from its qualifications or present the report as a guarantee or formal certificate.
Prices are displayed in Mauritian Rupees unless stated otherwise. The checkout must state whether VAT is included. Payment is processed through the designated payment provider.
A report order is accepted when payment is authorised and the platform confirms generation. We may reject or refund an order that cannot be processed lawfully or reliably.
Because report generation may begin immediately after payment, fees are generally non-refundable once generation starts, except where required by law or under the following service policy:
Dissatisfaction with an indicative estimate, market movement, a later professional valuation or a seller's asking price is not, by itself, a refund basis. This clause does not limit mandatory consumer rights. The final policy must specify the claim period, evidence and refund method.
The website, software, models, methodology, design, reports, compilations, brand and original content are owned by or licensed to PropertyValue.mu and protected by applicable intellectual-property law.
Payment grants a limited, non-exclusive, non-transferable licence to use the purchased report for its permitted purpose. It does not transfer model, database, software, trademark or methodology rights.
User content remains owned by the user or relevant rights holder, subject to the licence necessary to provide, secure, improve and, where authorised, display the service.
We may rely on registries, maps, planning layers, transaction records, payment gateways, cloud services and other third parties. We do not control their availability, update cycles, completeness or independent terms.
Third-party references do not imply endorsement. Where a data source imposes attribution, usage or redistribution restrictions, those restrictions apply.
Some narrative, classifications or summaries may be generated or assisted by AI. The AI layer is instructed to use structured platform data, but generated language may contain errors or omissions. The calculation, confidence and mandatory limitations shown in the structured report prevail over narrative wording.
Users should report apparent factual errors for review.
Property Directory use is also governed by the Directory Terms in section 8. Unless PropertyValue.mu is expressly identified as a licensed real estate agent in the transaction, it does not negotiate, conclude, guarantee or act as fiduciary for a listing.
Listings and enquiries do not create a sale, lease, agency, brokerage or advisory relationship with PropertyValue.mu.
We aim to provide a reliable service but do not guarantee uninterrupted availability. Maintenance, security events, third-party failure, data refresh, model updates and force majeure may affect service.
We may change functionality, methodology, evidence sources and report format. Paid reports remain linked to the model and data snapshot used when generated.
We may restrict or terminate access for non-payment, misuse, security risk, unlawful conduct, breach of these Terms, excessive automated access, regulatory requirement or conduct likely to harm users or the platform.
On termination, licences and provisions intended to survive - including intellectual property, confidentiality, liability, indemnity and dispute clauses - continue to apply.
To the fullest extent permitted by law, the services are provided on an "as available" basis. We do not warrant that an automated estimate will equal a transaction price or professional valuation, or that all evidence is complete, current, error-free or suitable for a particular purpose.
Nothing in these Terms excludes a statutory right or responsibility that cannot lawfully be excluded.
To the fullest extent permitted by law, PropertyValue.mu is not liable for indirect, consequential, special or exemplary loss; loss of profit, revenue, opportunity, finance, transaction, goodwill or data; or loss caused by reliance outside the permitted purpose.
For a consumer Smart Report, our aggregate contractual liability arising from that order should be capped at the amount paid for the affected report. For subscription services, the proposed cap is the fees paid for the affected service during the preceding 12 months. Enterprise liability must be negotiated in the signed agreement.
The cap and exclusions do not apply to fraud, wilful misconduct, liabilities that cannot be excluded by law, or another expressly agreed carve-out. Counsel must confirm treatment of gross negligence, data-protection claims, confidentiality and intellectual-property infringement.
To the fullest extent permitted by law, a business user, Enterprise client or listing provider will indemnify PropertyValue.mu against third-party claims, losses and reasonable costs arising from unlawful use, false or unauthorised content, infringement, breach of authority, illegal listings, misuse of reports or violation of these Terms.
A consumer indemnity should be limited and drafted fairly; legal counsel should confirm its enforceability.
Complaints should first be submitted to support@propertyvalue.mu with the report/order reference and supporting details. We will acknowledge and investigate within the published service period.
The parties should attempt good-faith resolution or mediation before litigation, without preventing urgent court relief or use of statutory complaint mechanisms.
These Terms are governed by the laws of the Republic of Mauritius. Subject to any mandatory consumer forum or agreed dispute process, the courts of Mauritius have jurisdiction.
Enterprise agreements may contain arbitration, expert determination or another negotiated dispute mechanism.
If a provision is invalid, the remaining provisions continue. Delay in enforcement is not a waiver. You may not assign your rights without consent; we may assign the agreement as part of a reorganisation or business transfer, subject to law.
The checkout, order summary, Privacy Policy, applicable service terms and these Terms form the agreement. Changes will be published with an updated date, and material changes may require renewed acceptance.
